Terms of Use
These Terms of Use (“Terms”) are a binding agreement between you and Future Design Works LLC, a California limited liability company (“Company”, “we”, “us”, or “our”), which develops and operates the BooksMade Spades mobile application and website (together, the “Service”). By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Acceptance of Terms
Use of the Service in any way — including as a guest, registered player, league or crew member, or tournament organizer — means you accept these Terms. We may update these Terms from time to time (see Section 16); continued use of the Service after an update takes effect means you accept the updated Terms.
2. Eligibility
You must be legally capable of entering into a binding contract to use the Service. If you are under the age required in your jurisdiction to do so without parental consent, you may only use the Service with the involvement and consent of a parent or legal guardian.
3. Accounts
You may create an account using Google or Apple sign-in, or via a one-time email passcode. You are responsible for maintaining the security of your account and for all activity that occurs under it. Let us know right away at support@booksmadespades.com if you believe your account has been compromised.
4. Subscriptions & Payments
Premium Access (ad-free gameplay, premium emojis and chat phrases, and Pro League Event & Tournament access), league creation, and League Pro boosts are purchased and managed exclusively through the Apple App Store or Google Play. Billing, auto-renewal, price changes, cancellation, and refunds for these purchases are governed by the applicable app store’s own terms and policies, not by us — refund requests should be directed to Apple or Google. Subscriptions renew automatically until cancelled through your app store account settings.
5. Online Play; No Guarantee of Service Availability
BooksMade Spades is an online, real-time multiplayer card game. Gameplay depends on your device, your internet connection, and the servers, networks, and third-party infrastructure that connect them — none of which we control. YOU ACKNOWLEDGE AND AGREE THAT WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR LAG-FREE GAMEPLAY, and that disconnections, latency, dropped packets, server downtime, scheduled or emergency maintenance, and other technical issues are an inherent and expected part of online play.
If you become disconnected during a hand, the Service may automatically play cards on your behalf using its built-in logic, and if you and your partner are both disconnected, your team may automatically lose the hand or game. This is designed functionality, not a defect, and you accept it by using the Service.
We are not responsible or liable for any consequence of a connectivity or technical issue, including without limitation: lost hands, games, matches, or tournament results; lost or altered rankings, ratings, streaks, or statistics; forfeited entry fees or prizes arranged outside the Service (see Section 6); or any other loss or inconvenience arising from your or another player’s connection instability, device performance, or the Service’s availability. We reserve the right to suspend, restart, or end any game, league, event, or tournament at any time for technical, maintenance, security, or operational reasons, without liability to you.
6. Leagues, Tournaments, Events, and Organizers
The Service allows users (“Organizers”) to create and run leagues, tournaments, and events for other users (“Players”) using our in-app tools (brackets, scorekeeping, and league/event management, made available via Premium Access, league creation, and League Pro purchases). Organizer status is available to any user who purchases the relevant feature — it is not a role we vet, credential, or endorse.
No Platform Payment Processing for Entry Fees or Prizes. Booksmade Spades does not provide, process, hold, escrow, or guarantee any entry fee, buy-in, prize pool, payout, or other monetary arrangement between an Organizer and Players. The only payments processed through the Service are Premium Access subscriptions, league creation fees, and League Pro boosts, billed exclusively through the Apple App Store or Google Play, and these are unrelated to any tournament entry fee or prize an Organizer may separately arrange.
If an Organizer collects money from Players by any means outside the Service — including cash, peer-to-peer payment apps, or third-party websites — that arrangement is solely between the Organizer and the Players involved. We are not a party to it, we do not monitor, review, approve, restrict, or endorse it, and WE ARE NOT RESPONSIBLE OR LIABLE FOR ANY DISPUTE, LOSS, NON-PAYMENT, FRAUD, OR OTHER ISSUE ARISING FROM IT, whether or not the underlying games are played using the Service.
Organizers and Players are solely responsible for ensuring any entry-fee, prize, or wagering arrangement complies with all applicable federal, state, and local laws, including gambling, gaming, and sweepstakes laws in their jurisdiction. We do not authorize, endorse, or knowingly facilitate illegal gambling, and we reserve the right, but not the obligation, to suspend or terminate any account, league, tournament, or event we reasonably believe is being used for an illegal or fraudulent purpose.
All disclaimers in Section 5 (Online Play) apply equally here — we make no guarantee that any tournament or event will run without technical failure or interruption, and we are not liable for any resulting effect on standings, eligibility, or any external entry-fee or prize arrangement.
7. Assumption of Risk
Online multiplayer gaming carries inherent risks, including interactions with other users, technical interruptions, and the matters described in Sections 5 and 6. You voluntarily assume all such risks by using the Service.
8. User Conduct
You agree not to:
- Cheat, use bots or automation not provided by us, or exploit bugs or glitches
- Harass, abuse, or threaten other users
- Use the Service to facilitate illegal gambling or any activity that violates applicable law (see Section 6)
- Attempt to disrupt or gain unauthorized access to the Service
- Impersonate another person or misrepresent your affiliation with us
We may suspend or terminate accounts that violate this section (see Section 14).
9. User-Generated Content
You may create content within the Service, such as games, leagues, display names, and chat messages (“Content”). You retain ownership of your Content, but grant us a non-exclusive, worldwide, royalty-free license to host, display, and transmit it as necessary to operate and provide the Service. We are not obligated to monitor Content, but may remove it or suspend accounts at our discretion, including for violations of Section 8.
10. Third-Party Services
The Service relies on third parties to operate, including Supabase (authentication and data hosting), RevenueCat and the Apple App Store / Google Play (subscriptions and purchases), and Sentry (error monitoring). We are not responsible or liable for the acts, omissions, availability, or performance of these or any other third-party service.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR ACCURATE, TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, GAME OUTCOMES, RANKINGS, OR THIRD-PARTY ENTRY-FEE OR PRIZE ARRANGEMENTS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless the Company from any claim, loss, or demand, including reasonable attorneys’ fees, arising from your use of the Service, your violation of these Terms or applicable law, or any entry-fee, prize, or other arrangement you make as an Organizer or Player outside the Service (see Section 6).
14. Termination
We may suspend or terminate your account or access to the Service at any time, with or without notice, for violating these Terms or for any other reason at our discretion. You may stop using the Service at any time.
15. Governing Law; Arbitration & Class Action Waiver
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court.
YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING. Arbitration will be conducted on an individual basis only.
16. Changes to These Terms
We may update these Terms from time to time. We will indicate the effective date of the current version at the top of this page. Continued use of the Service after an update takes effect constitutes acceptance of the updated Terms.
17. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms are the entire agreement between you and us regarding the Service and supersede any prior agreements on this subject. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
